Review carefully the terms and conditions set forth in this document before using iBetaTest. The terms "You", "Your", "User", or "Users" refer to anyone accessing iBetaTest for any reason whether it be a company or individual developer representing a business, single entity, or a tester.
By using iBetaTest (https://ibetatest.com/) you are agreeing to be bound by the following terms and conditions. iBetaTest and GeekSuit LLC reserve the right to update and change this agreement without notice. Any new features that augment or enhance iBetaTest shall be subject to this agreement. Continued use of this website after such changes shall constitute your consent to those changes. Violation of any of the terms will result in termination of your account.
a) This agreement is an electronic contract that sets out the legally binding terms of your use of iBetaTest's services. You indicate your acceptance of this agreement by clicking on the "I Accept" checkbox in connection with your registration. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
b) You must be 13 years or older to use this service. You understand and agree that we cannot be responsible for the content posted to which you potentially may be exposed. You agree to use this service at your own risk.
c) You must provide your legal full name, a valid email address, and all other information required to complete the registration process. For Developers, a valid credit card number is required to create Project Channels.
d) For the purpose of protecting Developers, Testers are required to read and digitally sign a Global Non-Disclosure Agreement. A Tester shall not disclose any information regarding software releases to which he/she is testing to other Testers, or any Third Party. Testers shall not duplicate, use, or distribute software releases being tested to anyone else.
Conversely, individuals or companies shall not register for purposes of baiting developers for software ideas or theft. Such software releases are provided on the iBetaTest website for the sole purpose of testing and reporting bugs only. Any other use is strictly prohibited.
e) You are responsible for all content submitted by you and activity that occurs under your account, even if you give access to others in your behalf. While administrators will attempt to verify account profiles are correct, we cannot be responsible for verifying any facts contained therein. You represent and warrant that you have the right to post all information and binaries submitted by you.
f) You are responsible for maintaining the security of your account and password. iBetaTest and GeekSuit LLC will not be liable for any loss or damage from failure to comply with this security obligation.
g) iBetaTest provides an excellent and convenient means to communicate with Testers who post Tickets. You may not solicit or encourage Testers (Beta Pool) to engage in or enjoin in any other personal or third party beta testing resource or network. There are no exceptions.
h) A Developer must either approve or decline the receipt of tickets from Testers. You are responsible for analyzing, testing, approving and fixing bugs as reported by Testers in a timely manner. Developer shall not use its iBetaTest account to post false or misleading project descriptions.
i) At its discretion, iBetaTest reserves the right to reject or edit any post(s), submitted ticket(s) or project channel(s) when necessary, and remove any post(s), submitted ticket(s) or project channel(s) or deny approval to the same.
j) You may not use iBetaTest for any illegal or unauthorized purpose. You must not violate any applicable laws in your jurisdiction, including but not limited to, copyright laws, laws relating to "spam" or right of privacy laws.
k) You may not reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of iBetaTest. It is illegal to register to this service for purposes to copy, emulate, or make similar use, in full or in part, for any other use or personal gain or enterprise. Those who have copied this service will be prosecuted to the full extent of the law.
l) No information submitted by you will contain any content that is false or misleading, obscene, libelous, slanderous or otherwise defamatory, or which violates copyright, right of privacy or other right of any person.
m) iBetaTest does not warrant that this service will meet your specific requirements, be error-free, timely, potentially uninterrupted, or the results that may be obtained from the use of this service will be accurate or reliable.
n) There are no refunds for any project channels in moderation or published. No exceptions will be made. In the event a project channel was denied, you may re-submit a new project channel. We will make every attempt to help you get it right.
o) At its sole discretion, iBetaTest has the right to terminate your account and refuse any and all current or future use of this, or any other iBetaTest service, for any reason at any time. Such termination will result in the deactivation or deletion of, as well as access to, your account and relinquishment of all content in your account. iBetaTest reserves the right to refuse service to anyone for any reason at any time.
p) Any written or verbal abuse, including threats of abuse or retribution, of any iBetaTest member, administrator, or officer will not be tolerated, result in immediate account termination, and where necessary be subject to the full extent of law.
q) The failure to exercise or enforce any right or provision of this agreement does not constitute a waiver of such right or provision. This agreement governs your use of iBetaTest, and supercedes any prior agreements between you, iBetaTest and GeekSuit LLC.
r) You shall indemnify and hold harmless iBetaTest, GeekSuit LLC, its affiliated companies, or third party vendors against any and all claims, losses, damages, liabilities, costs and expenses, including reasonable attorney's fees, arising out of, or relating to, any breach by you of the foregoing representations and warranties or otherwise arising out of, or relating to, the contents or nature of copy and other information provided.
